According to the draft minutes of the Oct. 25 meeting of the Pondera County Commissioners, Sheriff Carl Suta formally submitted a request to the Commissioners asking for the County to provide outside legal counsel for the purpose of pursuing an injunction on the recall election against him.
MACo legal counsel, as well as other resources were consulted and it was determined the recall process is a civil matter and is outside the County’s duty for representation of an elected official.
The Commissioners voted to deny Sheriff Suta’s request for legal counsel as the law governing recalls, or any other provisions of law, make no provision requiring the County to provide legal counsel.
In other news from the meeting, the commissioners:
•Approved the Encroachment Agreement with Tumbleweed Ranch for the purpose of building an approach for agricultural purposes at Old Shelby Road.
•Approved allowing an agricultural covenant to be placed on Tract 1 of Section 29, Township 29N, Range 3W as permitted under the Montana Subdivision and Platting Act, 76-3-101 through 76-3-625, MCA.
